Estate Planning – Frequently Asked Questions
We know that starting the estate planning process can raise a lot of questions — from how to structure your Will to whether you really need an Enduring Power of Attorney. This page answers the most common questions we receive from our clients, so you can make informed decisions with confidence.
What is estate planning?
Estate planning is the process of arranging how your assets, finances, and personal matters will be managed if you pass away or become unable to make decisions. It often includes a Will, Enduring Power of Attorney, Advance Health Directive, and superannuation nominations.
Why do I need an estate plan?
A good estate plan:
- Ensures your assets are distributed according to your wishes
- Reduces the risk of disputes between loved ones
- Protects vulnerable beneficiaries, such as young children
- Can help reduce tax obligations for your estate and beneficiaries
Without an estate plan, your assets may be distributed under Queensland intestacy laws, which may not align with your wishes.
What’s the difference between a Will and estate planning?
A Will is just one part of estate planning. Estate planning is broader — it covers all aspects of asset protection, decision-making, and future care planning, not just who inherits what.
How often should I update my estate plan?
We recommend reviewing your estate plan every 2–3 years, or sooner if you:
- Get married, divorced, or enter a new relationship
- Have children or grandchildren
- Buy or sell property or a business
- Receive an inheritance
- Move interstate or overseas
What happens if I die without a Will?
Your estate will be distributed under Queensland’s intestacy laws. This could mean certain family members inherit your assets, even if you wouldn’t have chosen them. In some cases, it can also cause disputes, delays, and additional costs for your loved ones.
What is an Enduring Power of Attorney and do I need one?
An Enduring Power of Attorney (EPOA) allows you to appoint someone to make financial, personal, and health decisions on your behalf if you lose capacity. It’s a critical part of any estate plan — without one, important decisions may be left to people you wouldn’t have chosen, or to the Public Guardian.
Can you come to me for estate planning meetings?
Yes. Our mobile legal service means we can meet you at your home, workplace, a café, or even in hospital, if needed — at no extra cost for travel.
How much does estate planning cost?
We offer fixed-fee estate planning packages, so you’ll know exactly what you’ll pay from the start. Our packages include meetings, document preparation, superannuation nominations, and secure Will storage.
What documents will I need to start?
We’ll guide you through what’s needed, but it’s helpful to have:
- A list of your assets and liabilities
- Details of your superannuation and insurance
- Names and contact details of people you want to appoint (executor, guardians, attorneys)
Any special wishes for gifts or bequests
Why do I need an estate plan if I’m young or don’t own much?
Even if you’re just starting out, an estate plan ensures the right people can access your bank accounts, superannuation, digital assets, and personal belongings — without unnecessary delays or legal headaches.
What’s included in your estate planning service?
We typically cover:
- Drafting a legally valid Will
- Appointing a Power of Attorney
- Guardianship decisions (for children or dependents)
- Business succession planning for company owners
- Advice on minimising inheritance disputes
- Secure storage of your legal documents
I own a business — how does estate planning help me?
It protects your company, employees, and family by setting out who will run the business, how ownership will transfer, and how your share will be valued. Without a plan, your business could face disruption or even closure.
Can you help with digital assets like online accounts and crypto?
Yes. We help catalogue and plan for the safe transfer or closure of digital accounts, intellectual property, and cryptocurrency wallets.
How long does the estate planning process take?
For most clients, we can complete an estate plan within 2–4 weeks, depending on complexity.

I recently used Kate Redman and Associates to update my Wills and POA. I couldn’t be more pleased with the experience.
Kate is knowledgable, professional and friendly throughout the whole process. She took the time to answer all questions, explained everything clearly and I never felt rushed even when I was unsure and it took a while to make some decisions.
I strongly recommend Kate and her team.
I could not be happier with the service I received from Kate. For years, we had put off getting our will sorted. Every time we looked into it, we put it into the “too hard” basket – both emotionally, and logistically. When we became parents, we knew we couldn’t put it off any longer. Then we found Kate. She came to our home at a time that suited us and talked us through everything in plain language. We didn’t have to book a day off work; we weren’t signing things we didn’t understand. We were able to talk through the ins and outs of each decision and get advice on the options before us. She was lovely to deal with. No question was too dumb. She took the time to lay it all out for us. It feels good knowing that we have plans in place; that there is no ambiguity as to our intentions to protect and provide for our family if the worst ever happened. When the time comes to update things as circumstances change throughout our lives, we know Kate and her team will be there to help us ensure everything is in order. Highly recommend.
We have recently worked with Kate Redman to get our wills and POA updated. The service was impeccable and Kate’s knowledge and level of care is second to none.
We feel very safe in her hands. The firm embraces technology but has not lost the human touch, which sets them apart. I highly recommend Kate Redman & Associates, they will take good care of you and make you feel safe.
